It was gathered that the plaintiffs lodged the suit at the Federal High Court in Abuja, Nigeria’s capital.
Concise News understands that the plaintiffs, according to the suit marked FHC/ABJ/CS/462/2019, are praying the court to direct Adeleke to refund all salaries, allowances and other emoluments he has received as a senator.
They filed the suit pursuant to Section 65(2)(a) of the 1999 Constitution, and the judgment of a Federal Capital Territory (FCT) High Court sitting in Bwari, delivered on April 2, 2019.
Justice Othman Musa of the Federal Capital Territory High Court in Bwari had held that Adeleke failed to prove in court that he graduated from a secondary school, as required by section 177 of the Nigerian Constitution.
According to the judge, the results Adeleke attached to his form CF001, which he submitted to the Independent National Electoral Commission (INEC) for the Osun governorship election, was fake.
Listed as respondents are Senator Adeleke, the Peoples Democratic Party (PDP), the Nigerian Senate, the Senate President, and the Independent National Electoral Commission (INEC).
